BUILDING ENERGY RATING (BER) CERTIFICATES

European Community (Energy Performance of Buildings) Regulations 2006

From 01 January 2009, all existing residential and non-residential buildings are required by law to have a BER Certificate if they are being placed on the market for sale or rental. Since 2007, this has been a requirement for new buildings.

Any potential purchaser or tenant of your property is entitled to ask to see the BER Certificate and if the regulations are not complied with, fines up to €5,000.00 will be applied. From now on it is a breach of the act to put any property on the open market that does not have a valid BER Certificate. All existing properties already on the market must now get a BER Certificate also. The Certificate has a validity period of 10 years, provided there are no material changes to the building that could affect its energy performance.

A list of Accredited Assessors may be accessed on the Sustainable Energy Ireland website at www.sei.ie. There are a number of Accredited Assessors providing a service in this area.
